我(wo)市某(mou)家(jia)電(dian)賣場的張某(mou)是某(mou)品牌家(jia)電(dian)的銷售員,近(jin)日其廠家(jia)因裁員要其主動離職。在此工作(zuo)了(le)14年(nian)的(de)(de)張某心有不(bu)甘(gan),不(bu)愿(yuan)離職。奈何廠家以銷(xiao)量虛(xu)假為由,表示將與張某解除勞動關(guan)系,無論其是(shi)否同意,都會(hui)向其寄送(song)離職函(han)等相(xiang)關(guan)文(wen)件(jian)。張某很茫然,廠家寄來(lai)的(de)(de)離職函(han)到底(di)要不(bu)要簽收?工作了14年(nian),如果真(zhen)的(de)(de)被辭退,能(neng)不(bu)能(neng)得到賠償?
就(jiu)此,山東荊河(he)律師事(shi)務所于浩亮律師給出解(jie)答。于浩亮律師指出,公(gong)(gong)司(si)(si)(si)(si)以(yi)(yi)員(yuan)工(gong)(gong)違(wei)(wei)反(fan)公(gong)(gong)司(si)(si)(si)(si)規章制(zhi)(zhi)(zhi)度為由與(yu)員(yuan)工(gong)(gong)解(jie)除(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong),必(bi)須同(tong)(tong)(tong)時具備(bei)兩個(ge)條(tiao)件:第(di)一,員(yuan)工(gong)(gong)確實有嚴重違(wei)(wei)反(fan)公(gong)(gong)司(si)(si)(si)(si)規章制(zhi)(zhi)(zhi)度的(de)行為。第(di)二,公(gong)(gong)司(si)(si)(si)(si)有合(he)(he)(he)(he)法(fa)(fa)有效的(de)規章制(zhi)(zhi)(zhi)度,并且規章制(zhi)(zhi)(zhi)度已經(jing)向員(yuan)工(gong)(gong)公(gong)(gong)示。我國《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)法(fa)(fa)》明(ming)確規定(ding),用人(ren)(ren)單位單方(fang)解(jie)除(chu)與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者之間的(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)必(bi)須具備(bei)法(fa)(fa)定(ding)條(tiao)件、遵守法(fa)(fa)定(ding)程序。公(gong)(gong)司(si)(si)(si)(si)違(wei)(wei)反(fan)《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)法(fa)(fa)》解(jie)除(chu)或者終止與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)的(de),員(yuan)工(gong)(gong)可以(yi)(yi)依據《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)法(fa)(fa)》第(di)四十(shi)八(ba)條(tiao)的(de)規定(ding),要求公(gong)(gong)司(si)(si)(si)(si)繼續履行勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)或者要求公(gong)(gong)司(si)(si)(si)(si)支付(fu)賠償金。本案(an)中,張某可以(yi)(yi)簽收(shou)廠家寄來的(de)離(li)職函,在收(shou)到公(gong)(gong)司(si)(si)(si)(si)的(de)解(jie)除(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)通知書以(yi)(yi)后(hou),可以(yi)(yi)向當(dang)地(di)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)人(ren)(ren)事(shi)爭(zheng)仲裁(cai)(cai)委員(yuan)會申請(qing)仲裁(cai)(cai),維(wei)護自己的(de)合(he)(he)(he)(he)法(fa)(fa)權(quan)益。
法條(tiao)鏈接(jie) 《中華人(ren)民(min)共和(he)國勞動合同法》第三十九條:勞動者有下(xia)列(lie)情形之一的,用人(ren)單位(wei)可(ke)以(yi)解除勞動合同: (一(yi))在試(shi)用期間被證明不符合錄用條件(jian)的; (二)嚴重違反用(yong)人單位的(de)(de)規章制(zhi)度的(de)(de); (三(san))嚴重(zhong)失職,營私舞弊,給用人單位造(zao)成重(zhong)大損害(hai)的(de); (四)勞動者同(tong)時與其(qi)他用人單位(wei)建立(li)勞動關(guan)系,對完(wan)成(cheng)本單位(wei)的工作任務造(zao)成(cheng)嚴重影響,或者經用人單位(wei)提出(chu),拒不改正(zheng)的; (五)因本法第(di)二十(shi)六條(tiao)第(di)一款第(di)一項規定的(de)情形致使勞動合同無效的(de); (六)被依法追(zhui)究刑事(shi)責任的。 第(di)四十(shi)八(ba)條(tiao):用(yong)人單(dan)(dan)位(wei)(wei)違反本(ben)法規定解除或者(zhe)(zhe)(zhe)終止勞動合同(tong),勞動者(zhe)(zhe)(zhe)要求(qiu)繼(ji)續(xu)履行(xing)勞動合同(tong)的(de),用(yong)人單(dan)(dan)位(wei)(wei)應當繼(ji)續(xu)履行(xing);勞動者(zhe)(zhe)(zhe)不要求(qiu)繼(ji)續(xu)履行(xing)勞動合同(tong)或者(zhe)(zhe)(zhe)勞動合同(tong)已(yi)經不能繼(ji)續(xu)履行(xing)的(de),用(yong)人單(dan)(dan)位(wei)(wei)應當依照(zhao)本(ben)法第(di)八(ba)十(shi)七條(tiao)規定的(de)二倍(bei)支付賠償金(jin)。 |
